Groovera webcasts and other content available on and through Groovera.com (collectively "Content") are provided by Qaz Media LLC for your personal use only. By using the Groovera website and/or Groovera's media streams, you agree that you will not store, reproduce, transmit, publish, broadcast, redistribute, or otherwise make available the Content or any portion of the Content, whether electronically or in any other form, and whether for commercial purposes or any purpose other than your own personal use, unless approved in writing by Qaz Media LLC. Written consent may also be required by the copyright holders of the sound recordings and/or song composers presented via Groovera.com streams for any activities other than ordinary personal use.
Systematic retrieval of Content, most notably, stream recording or "Ripping" (including copying of website content, playlist logging, "trainspotting, "website ripping", "stream ripping"), directly or indirectly, to create or compile a music collection, database or media archive for personal OR commercial use is strictly prohibited. Ripping any Groovera webcast is in violation of U.S. and international copyright laws and may result in permanent refusal of service.
Falsification of user agent data is prohibited by United States federal law in accordance with the Digital Millenium Copyright Act of 1998 (DMCA) and is subject to permanent refusal of service.
Linking to Groovera.com or Groovera.com web pages from non-Groovera websites is considered fair use and is encouraged. However, listing Groovera web media stream addresses, URL's, and URI's on ANY website OR hyperlinking directly TO Groovera media streams from ANY website (including "inline linking", "direct linking", "deep linking", "hotlinking", "leeching", or "piggy-backing" whether by use of a web page embedded media player OR by listing or describing Groovera stream addresses, URL's, and URI's WITH OR WITHOUT hyperlinks) is strictly prohibited under all circumstances and without exception and will be treated as theft unless expressed permission has been granted in writing by Qaz Media LLC.
Groovera and its Content are provided "AS IS" and without warranty. All activities on Groovera.com and their corresponding IP addresses are logged, as is typical of all websites and online services, and may be used as legal evidence against violators of these terms of use and/or any pertaining copyright laws, US Federal or international.
Third Parties
Neither Groovera nor Qaz Media LLC claims any right or ownership to any third-party intellectual property without expressed permission from the rightful trademark and copyright holders. However, all materials submitted directly to Groovera.com by recording artists, record labels, artist managers and/or distributors demonstrates implied statutory copyright license, permission, and expressed consent for Groovera to use materials and assets presented freely and without royalty compensation whether in web media stream performance, live Groovera appearances including DJ performances, or in radio "spots", with the expected exchange being audience exposure and/or additional mechanical sales and/or merchandise sales.
Trademarks
Groovera is a trademark of Qaz Media LLC and may not be used without expressed permission. Jet City Lounge, Audio Popsicle, Ambient Popsicle, Low Mercury, Jazz ala Mode, Exotic Lounge, Up With A Twist, Surrea Lounge, Soul Nouveau, Hibernation Station, Mix Elixir, Parlor Amour, Chill Degrees, Jazz Degrees, Nada Pop, The Dark Room, FrostByte Groove Lounge, OverXposure, OverXposure.FM, the slogans "Boot up... Tune in... Chill Out." and "Web Radio. Chilled Grooves. True.", and the "ripple" design are service marks of Qaz Media LLC and may not be used without expressed permission. Designated trademarks, service marks, and brands featured on this website are the property of their respective owners.
Copyrights
Groovera reserves all rights to its media streams, which are protected under international law as copyrighted collections. Additionally, all intellectual property dispensed via Groovera.com and within its webcasts is copyrighted by their respective owners. Qaz Media LLC maintains direct permission to play most of the material on Groovera.com through artists, record labels, and/or artist management. Qaz Media LLC also maintains membership with ASCAP for statutory licensing of copyrighted sound recordings and has filed a Notice of Use of Sound Recordings with the United States Library of Congress. No known BMI or SESAC interests currently are represented via Groovera. Qaz Media LLC reserves all rights to its website system, content, source code, software, designs, graphics, webcasts, and all other assets available through Groovera.com as copyrightable intellectual property.
